Tips For A Safe Holiday Season | College Park Attorney

We are proud to serve the Metro Atlanta community and want to wish everyone a joyous holiday season. We hope that your holiday season brings merriment, joy and family bonding.  As you celebrate the season and bring in the New Year, please be safe and cautious.  Here are a few tips we would like to share with you to ensure that your holidays go off without a hitch…

HAVE DESIGNATED DRIVERS FOR CELEBRATIONS: Drinking and driving is a serious issue during the holidays and can have deadly consequences. Be sure that you or anyone else you are with does not drink and drive. Georgia offers safe ride programs that you can take advantage. Check out saferideamerica.org for more information.

FIND A SAFE LOCATION TO BRING IN THE NEW YEAR: Be sure that you surround yourself in a safe environment with friends and family you trust. Don’t expose yourself to unsavory areas or people. Also, make road travel as minimal as possible as drunk driving increases for this holiday.

SHOP WITH A PARTNER: Shopping is a big part of the holiday season and unfortunately so are robberies.  Shop during daytime hours, park close to the door and have 1 or 2 people with you. There is safety in numbers.  Also be mindful of your surroundings inside and outside of the stores. Is anyone following you? Is your purse and wallet secure?  Does this store have cameras and security?  These are all questions you want to have top of mind.

We hope these tips will help ensure that your holidays are safe and pleasant. Enjoy your holiday season and have a wonderful New Year!

What To Look For In A Personal Injury Attorney | College Park Personal Injury Attorney

Personal injury lawyers seem to be everywhere you turn. You see them on TV, hear them on the radio, some of you probably even receive direct mail from them now and then.  Still, when the time comes to choose a personal injury attorney you need to know what to look for.  Here are some things to consider when it comes to selecting a personal injury attorney:

COMPASSION COUNTS  When you are seriously injured, you feel upset and vulnerable in additional to actual physical pain as well. The last thing you need to  add to your problems is a lawyer that sees dollars signs when they look at you, rather than seeing you as a real person with serious emotional, physical and financial needs that need attention. Compassion cannot be underrated. When your attorney truly cares about you, that will translate into how hard they will work for you to win your case and get you the settlement you deserve.

PERSONAL ATTENTION   Is your attorney willing to give you one on one personal attention or will you just be pawned off on a low level associate or secretary whenever you need help or have questions?  Having a personal injury attorney who will take the time to consult with you and represent you personally can make all the difference in the world. You want to feel confident that you will have someone to depend upon that knows the law and will fight to protect your rights.

TRACK RECORD OF SUCCESS   Does your attorney have real hands on trial and settlement experience? Can they layout a history of a real cases and cash awards that they have won?  If they are vague or avoid these types of questions, this is not the personal injury attorney for you.  An experienced personal injury attorney is critical to winning your case.

The Foster Firm knows personal injury law and has a track record of impressive awards. We care about our clients and work hard on their behalf. Tips For Avoiding Accidents With Semi-Trucks On The Road | Truck Accident Attorney College Park

We all see them zipping along our Georgia roads and highways… semi-trucks. They can be intimidating to say the least. You know a collision with such a huge vehicle can be deadly. The best defense is a good offense when it comes to avoiding a truck accident.  Here are a few tips that may help you stay safer on the road…

Watch carefully: If you notice the semi truck or tractor trailer near you is swerving, poorly keeping their lane or has a driver that looks glazed over, STAY AWAY. If at all possible, do not drive in front of, behind or beside that truck. Try to stay at least 3-4 cars away from it at all times.

Be aware of blind spots: Tractor-trailers have large blind spots, called "no-zones." These are positioned at the rear of the truck, the side, and the connecting point between the truck and the trailer.  If you plan to pass, it is imperative that you know for sure that the driver is able to see you.

Keep a safe distance: If you are in a position that you have to drive near a semi-truck, keep as much distance as possible. Over 15 car lengths is preferable.  You want plenty of space to be able to maneuver and/or stop if something unexpected happens.

If you already have been in an accident with a truck, call us. As an experienced truck accident attorney in College Park, we can protect your rights and fight for your compensation.  Our accomplished and experienced College Park truck accident lawyers take a very aggressive approach to your recovery efforts. Accidents are traumatizing enough, be sure to protect your rights.

3 Things To Consider When Hiring An Attorney | College Park Attorney

Hiring an attorney can be a difficult task. Normally if you are in the position of needing an attorney, you are most likely already in a stressful or compromising situation.  You know you need to protect your rights, but are just not sure what attorney to choose.  Here are 3 things to consider when hiring an attorney:

1. Ask Those You Trust: You can’t just believe that a flashy TV ad equals a great attorney. Also, keep in mind that someone is paying for those ads… their clients. Many experienced and effective attorneys do little to no advertising at all.  If no one close to you can refer you to an attorney, schedule a few appointments for complimentary consultations with local attorneys to gather more information. Also, check them out online for reviews, complaints, etc.

2. Be Prepared With Pertinent Questions: When calling or visiting an attorney for a consultation be prepared. Write down a list of important questions you want answered, including education, win/loss history, specializations and years of experience.

3. Understand Their Payment Options: You need to know your costs and payment options upfront. Contingency payment plans are often beneficial for many clients, but consider how much you are paying overall, not just when you have to pay it.  You may not want the cheapest lawyer you find, but you do want fair fees and nothing adsorbent.

If you need an attorney in College Park, GA or a neighboring city, feel free to call us for a complimentary consultation.  We are trusted personal injury and criminal defense attorneys that will fight to protect your rights.

What To Do If You Have A “Slip & Fall” Accident | Slip & Fall Attorney College Park & Atlanta

A slip and fall accident can happen almost anywhere.  Something as simple as shopping at the mall can lead to tripping over a misplaced rack or just walking up to a building can lead to falling over broken concrete. The most mundane routine activity can lead to a devastating injury due to a slip and fall accident. The financial devastation, loss of work and emotional upset can leave you in ruin.  So how do you deal with a slip and fall properly so that you can protect yourself?  Here are a few tips on what you should do if you are involved in a slip and fall:

Take Note of Witnesses: If you are in public, witnesses should be plentiful, get as much contact information from them as you can for future reference. Ask them to wait to make statement for the accident report as well.

Take Pictures of the Scene: Get images of the whole scene, including signs and full circumstances.

Alert Security and/or the Police: If you have your cell phone on you and you are injured, call the police to the scene. If you don't have a phone, have someone else on the scene call for you. Also, have someone get any local security for your location if they are available.

Go to the Doctor: If you were injured, see a doctor right away. If you are immobilized or severely injured, call an ambulance to the scene for transport. Even if your injury “doesn’t seem that bad”, you need to visit the doctor because many injuries get worse over time. You want to be sure you can link your injury to any future loss of work, pain or disability that may result from the slip and fall.

Consult an Attorney: If you try to attempt to settle or negotiate with the owner of the establishment on your own, chances are they will try to only cover minimal hospital bills and have you release them from any further liability. An experienced slip and fall attorney is critical to protecting your rights and ensuring you get the compensation you deserve for your injuries.

The Foster Firm Client Reviews | Attorney Keith Foster Reviews

We are passionate about our clients' cases and work diligently to fight for their best interests. We have built a reputation of success and excellence throughout Metro Atlanta.  As a result, a high percentage of our business is from repeat customers and referrals.  Here are a few actual client reviews we would like to share with you…

“Keith Foster is a very good attorney! When my sister got into legal trouble I was referred to him by a friend. I called him up and he personally talked with me for 30 minutes, then scheduled me an appointment to come in. When I got there he showed genuine concern about my sister's case and her life. Foster's prices were very reasonable and he even let me make payments. On the day of court he went to battle for my sister, never giving up on her even though it wasn't looking good for her. Attorney Foster did an amazing job and I was very pleased! So was my sister! I still call him sometimes for advice. I referred him to other family members.”
-Tywanda

“We are from Ohio and hired Attorney Keith Foster to represent my nephew who was convicted in cases in two separate counties in Atlanta. Atty Foster not only worked out a great deal on sentencing for my nephew, but he worked directly with both probation divisions and the G.D.C. to ensure a mix-up in paperwork was handled quickly [in less than 24 hrs] to ensure my nephews release from prison. He also returned ALL of my calls promptly. We are forever grateful to the Foster Law Firm!”
-Cecilia

“A pleasure to do business with. Reliable, determined and persistent on getting what is rightfully owed on your behalf. They thrive on not just being the best for themselves, but for you.”
- Melvin

Make Your Home Safer To Reduce Personal Injury Risks & Lawsuits | Personal Injury Attorney Atlanta

Thousands of people are injured and killed every year from accidents in there home. Most of these accidents are completely preventable. Falls comprise the largest percentage of in home accidents that result in injury or death.  There are things you can do to make your home safer and reduce the risks of falls and injury to others in your home. Not only will you be safer, but you will reduce your risk of being sued because someone was injured in your home.

Here are a few suggestions for making your home safer…

HAVE STABLE HANDRAILS IN YOUR HOME THAT ARE UP TO CODE
In most cases, handrails are required in your home for any staircase. Make sure they are sturdy, in tact and have no dangerous protrusions.

KEEP YOUR STAIRS FREE FROM DEBRIS AND BE SURE THEY ARE UNIFORM
Falling on stairs commonly lead to injuries in the home.  Never allow toys, stray carpet threads, loose nails or objects to interfere with your stair's safety.

KEEP DOGS AWAY FROM YOUR GUESTS
We all like to think that our dog is friendly and will never bite anyone, but that simply is not the case. Even a normally calm and gentle dog, may exhibit aggressive behavior without warning. Keep your dog safely away from guests whenever they visit your home.

If you have more questions on preventing falls or injury or have been involved in a fall or injury in someone else’s home or business, call us today.

Have You Been Bitten By A Dog? | Personal Injury Attorney Atlanta

Dog bites can be serious! It's important that you speak with an experienced attorney when you are bitten by a dog so that you can protect your rights and recover any financial losses. Georgia has a specific statute related to dog bites.

This Georgia statute represents the state's relevant dog bite strict liability law.  While the law imposes strict liability for injury to a person, the dog (or other animal) must first be considered "vicious" or "dangerous," which can be as simple as showing the animal was required to be leashed per city ordinance.  Second, the animal must be at large by the careless management of the owner.  Finally, the person injured must not have provoked the animal into attacking him or her.

IF YOU HAVE BEEN BITTEN BY A DOG CALL THE FOSTER FIRM TODAY!

Supporting Your Personal Injury Case | Personal Injury Attorney Atlanta

When you are injured because of someone else’s negligent or malicious actions, it’s not greedy or wrong to seek deserved compensation. Physical injury almost always results in financial loss and pain & suffering. Recouping that loss and being compensated for your pain is important and just. You have to be able to prove your loss and pain & suffering legally though. Here are a few tips that may help you support your personal injury case in court or settlement negotiations.

DOCUMENT EVERYTHING
Your attorney needs your help to fully prove your case. To prove your case, you need evidence. So keep all paperwork and receipts that are in any way related to your injury. Also, take photos, record witness contact information and get documentation from your employer showing loss of income and/or disability status.  You will also need documented proof, including wage statements, showing what you earned before you were injured. All of this documentation will prove very useful to both you and your attorney.

DO NOT SPEAK WITH THE INSURANCE COMPANY
In most instances, the insurance company is simply trying to settle for the least amount of money possible. Insurance companies typically have many experienced lawyers on their payroll that will be working hard to get you to settle or to disprove your claim.  In light of the many fraudulent claims made against insurance companies, they are often hyper vigilant in denying claims or settling claims for meager amounts of money.  Allow an experienced attorney to speak to the insurance company on your behalf.

BE ABLE TO PROVE YOUR PAIN & SUFFERING
Since pain and suffering is not something that someone else can touch, see or feel directly, it can be difficult to prove. Even though it may be difficult to document, it is an important aspect of your personal injury claim.  The best way to prove pain and suffering is to be detailed, specific and proactive.  Don’t ignore pain or assume it will go away any time soon. Keep a journal outlining your daily pains and level of pain. Also, log dates and instances of specific activities you can no longer engage in because of your pain.  Be specific when documenting your pain, including where the pain is, how intense the pain is and why and how it is impacting your activities and daily quality of life.

3 Things Every Plaintiff Should Know | Personal Injury Attorney Atlanta

When you have been injured or suffered damages due to another’s negligence you deserve compensation.  Sometimes individuals with legitimate claims lessen their ability to recover damages because they make mistakes simply because they didn't know the law.  Here are 3 tips every potential plaintiff should keep in mind to help ensure proper damage recovery…

1. Know the Statutes of Limitation for Your Claim: Legally you are given a specific time frame in which you can file a legal cause of action.  If you wait beyond the statute of limitation for your particular legal claim then your right to sue will no longer exist.

2. Proper and Timely Discovery: Witnesses, evidence, documents and fact gathering need to begin immediately.  You need a comprehensive discovery plan to ensure important evidence is gathered, motions are filed on time and all relevant facts are uncovered.

3. Plead The Appropriate Causes Of Action: Depending on your specific situation there may be numerous causes of action that apply.  Many plaintiffs fail to plead all the available causes of action to them or even plead the wrong cause of action...

Protect your rights as a plaintiff and get the settlement you deserve.  Recovering from an injury or significant loss is difficult and recovering the monies legally due to you is an important part of the healing process. Feel free to contact us if you have additional questions on protecting your rights as a plaintiff.
